Company Pursuing a Claim below a Value Engineering Change Provision Has weight of Proving Its Claim

In Applied Companies, (68) the ASBCA rul that Applied failed to establish a rule cost savings and therefore did not establish entitlement. upon 29 August 1985, the Army awarded sum of two units contracts to Applied, requiring Applied to exhibit horizontal air conditioning units. (69) The contracts included a value engineering clause (70) enticing contractors with a fifty percent share of any realized savings. (71) Pursuant to this clause, Applied submitted plans to help the Army save currency while using these horizontal air conditioners. (72) Although these plans did save circulating medium with the 36K BTU/HR air conditioner pattern (73) the plans did not help the conduct save money with other air conditioner originals (74)

Although it lacked technical and take away from data to establish entitlement, Applied argued it should gather under the Value Engineering Change Provision (VECP) clause because the VECP program, as submitted, could be applied to any air conditioning unit. Applied asserted that the conduct has the burden of demonstrating wherefore the claimant should not share in any take away from savings as claimed verses the contractor having to verify "the dollar amount of futurity cost reductions." (75) The conduct responded that Applied only submitted a VECP plan for the 36K BTU/HR unit and did not do any design work for other air conditioning archetypes (76) Accordingly, the government reasoned that Applied was not entitled to a percentage of coming time savings regarding the other air conditioning units. (77)

The ASBCA agreed with the management It noted that before the regulation can calculate an amount to be paid under a VECP clause, the contractor is "required to submit to the [contracting officer] the savings amount and technical basis for each [claim] asserted." (78) In addition to explaining this load the ASBCA observed that "the facts are clear--[Applied] did not come [i]or[/i] go after [i]or[/i] behind though with technical and take away from details necessary to apply the VECP to other [air conditioning] configurations." (79) Because of this, the Board throw overboarded Applied's claim for increased payments pursuant to the VECP program.
