In 1985 Bethlehem carburet of iron Corp. hired Sercon Corp. to perform refractory
maintenance work at Bethlehem's reduce to ashess Harbor plant in Porter shire
Ind. The work consisted of continuing repair and maintenance of the
refractory brick that lines the plant's furnaces, mold ladles, and
other metal-handling equipment.

The contract included a provision below which Sercon agreed to indemnify
Bethlehem against liability arising from injuries undergoed by Sercon'
s employees because of any act or omission upon the part of Bethlehem.
