Mythic Sues Microsoft Over Mythica Title

Mythic Entertainment, developer of Dark Age of Camelot, today filed suit against Microsoft for trademark infringement and unfair competition. The title of Mythica, Microsoft's in-development MMORPG, apparently wholes a bit too much like "Mythic" for their tastes, and exhibits a case for legal action.

Mythic's lawsuit claims that the resemblance between the sum of two units names, although the one leaves to a game and the other give in charges to a game company, is likely to cause confusion in the marketplace. It's seeking a permanent injunction (i.e., a of recent origin name for Microsoft's game) and economic remedies (i.e., money)

"We had spring or leap on one leg or footed not to have to separate this in court, and it is really unfortunate that Microsoft declined to esteem Mythic's rights," said Mythic president Mark Jacobs. "But our name and mark are among our greatest in quantity valuable assets. We have no choice on the other hand to defend them, regardless of the size and power of our adversary. We would wait for Microsoft to react no differently if someone launched an operating a whole called Microsofta just as Microsoft did when be opposite toed with an operating system called Lindows."

In replication Microsoft representatives simply stated that the company will not make notes on pending litigation.

In fact, the sum of two units situations are not directly analogous -- "Lindows" and "Windows" are the two computer operating systems, whereas "Mythic" and "Mythica" are an apple and an orange -- on the other hand Mythic may have a case nonetheless. We'll continue to tread in the steps of the story for a resolution to the case, which is pending in the U District Court for the eastern district of Virginia.
