Still Life formerly attributed to Jean-Simeon Chardin (1699-1779) possibly nineteenth hundred Oil on canvas, 33 x 28 cm Burrell Collection (Glasgow City Council)

Provenance Paul Bureau, Paris; auction, Paris, 20 May 1927; A.S. Drey gallery, Munich, 1927; Paul Graupe auction, Berlin, 16-17 June 1936; Julius Bohler gallery, Munich, 1936; Sir William Burrell Glasgow, 1936; Glasgow City Council, 1944

Background APOLLO has established that the holder of the painting, who has not previously been named, was the Munich-based A.S. Drey gallery in the early 1930 Following an extortionate tax demand from the Nazi authorities, the Jewish-owned gallery sold a great deal of of its stock at auction in Berlin upon 16-17 June 1936. The Still life, then accepted as an authentic Chardin, went for the equivalent of 560 [pound sterling].

Although unnamed in the Spoliation Advisory Panel report, the buyer was another Munich dealer, Julius Bohler who immediately sold the painting to Burrell It was part of the collection which he at handed to Glasgow City Council in 1944

Claim The claim was made in August 2001 by the agency of the children and grandchildren of five former Jewish shareholders in the Drey gallery. In May 2003 it was referr to the Spoliation Advisory Panel, whose report was published upon 24 November 2004. This conclud that the claimants 'have established a sufficiently robust moral case to justify the award of a remedy'

Now alone 'formerly attributed to Chardin', the painting has a not absent value of just 7,500 [pound sterling]. The panel commended restitution, but there are restrictions upon deaccessioning from the Burrell Collection. In March 2005 Glasgow City Council decided that deaccessioning would not be possible, and that it would therefore make open discussions with the claimants to proffer an ex gratia payment of 10000 [pound sterling].
