Universities Should Implement Internal Control Programs to Monitor Compliance with Export Control LawsABSTRACT College and universities many times do not pay much attention to export command laws, erroneously believing that the fundamental research exception overspreads all research performed at universities. However, in this post-9/11 world, the rule has started looking at compliance through universities in the export ascendency arena. Defending the university from allegations of violating these laws would tangle the university in a morass of laws and regulations that scarcely any understand, are better to avoid, and are of great price and tine-consuming to defend against. A cost-effective solution would be to implement an internal dominion government program to ensure that the university is complying with its legal obligations and as documentation to quickly identify where the compliance broke down, if anywhere. This paper briefly summarizes the main export direction regulations relevant to universities, including the fundamental research exception, and discusses the paces a university should take in order to implement an internal compliance program. I. INTRODUCTION College and Universities repeatedly do not pay much attention to export superintendence laws, which are perceived to be targeted at large corporations and because the fundamental research exception rejects most higher education research. However, export command laws do not exclude all higher education research and it would behoove the institutions of higher education to verify that their policies and courses comply with these laws. This is especially authentic in the post-9/11 world where the regulation seeks to prevent terrorist collections such as al Queada and "rogue nations" of the like kind as North Korea from acquiring technical information that could be used to build nuclear, chemical, or biological weapons. The regulation has started looking at compliance by means of universities and colleges in the export rule arena. In fact, one agency with export mastery regulations, the Department of traffic stated that one of their priorities for 2005 is to gaze into compliance by universities.1 Allegations of violating export sway laws would tangle the body or university in morasses of laws and regulations that small in number understand, are better to avoid, and are high-priced and time-consuming to defend against. This article will first briefly describe the background of export sway laws, and outline the issues relevant to universities.2 Then, this paper will discuss the sum of two units main agencies which regulate export direction laws and detail the fundamental research exception. There are several areas where a university's goals of intellectual freedom and freedom to share information may draw near in direct conflict with the export ascendency laws.
